This appeal presents questions of first impression on the interpretation and constitutionality of the railroad-crossing statute, Iowa Code section 476.27 (2009). This statute was enacted to facilitate public utility crossings over railroad tracks. It authorizes a "pay-and-go" procedure with a legislatively predetermined $750 standard crossing fee the utility pays to the owner of the railroad right-of-way.
