This is the second appeal in the second lawsuit to arise from a motor vehicle accident in which an automobile struck and killed a pedestrian. In the first lawsuit, the pedestrian's estate sued the driver of the automobile and a jury awarded damages. In this second lawsuit, the estate is seeking underinsured motorist benefits from the decedent's insurer.
