In this appeal, we must decide if the district court properly dismissed the State's petition seeking the civil commitment of Galen Kendrick Shaffer as a sexually violent predator. The district court determined Shaffer was not presently confined as required by the Sexually Violent Predator Act and dismissed the petition.
