A defendant appeals his conviction following a bench trial on two separate class "D" felony charges: failure to register as a sex offender (second offense) and failure to appear at trial. Although the defendant was charged as a habitual offender, the district court rejected, without holding a separate hearing, the State's claim as to defendant's habitual offender status.
