Paramount Contracting Company needed several hundred truckloads of dirt for a construction project, and DPS Industries, Inc. had dirt. DPS offered to sell its dirt to Paramount and to haul the dirt to the construction site. DPS says that Paramount accepted this offer, but Paramount denies it. Paramount ultimately bought dirt from another vendor, and DPS sued Paramount for breach of contract. The case was...
