MORGAN v. STATE

No. A11A0008.

706 S.E.2d 588 (2011)

MORGAN v. The STATE.

Court of Appeals of Georgia.

February 23, 2011.

Attorney(s) appearing for the Case

Timothy A. Siler , Greensboro, for appellant.

Patrick H. Head , District Attorney, John R. Edwards , Assistant District Attorney, for appellee.

MIKELL, Judge.

Dennis Ralph Morgan appeals the denial of his plea of double jeopardy, contending that his probation revocation in state court for driving on a suspended license precludes his indictment in superior court for the offense of habitual violator arising out of the same incident. "The appellate standard of review of a grant or denial of a plea in bar of double jeopardy is whether the trial court's findings support its conclusion."1
