Following a jury trial in 2006, Larry Presley was convicted of aggravated stalking and acquitted of making terroristic threats. Pursuant to the grant of an out-of-time appeal, Presley argues that his trial counsel rendered ineffective assistance and that the trial court's jury charge on aggravated stalking was unconstitutionally burden-shifting.
