In Case No. A09A1459, Golden Atlanta Site Development, Inc. ("Golden"), appeals from an order of the State Court of Cobb County which granted summary judgment to plaintiff R. Nahai & Sons, Inc. ("Nahai & Sons") on its breach of contract claim. The court ordered Golden to refund $200,000 in earnest money Nahai & Sons paid to Golden pursuant to a real estate contract between the parties.
