Nicholas Holowiak was stopped at a roadblock and charged with driving under the influence of alcohol as a less safe driver and with a blood-alcohol content (BAC) over 0.08. He filed numerous motions challenging the propriety of the roadblock and the test results from the Intoxilyzer 5000 machine that used his breath to measure his BAC.
