A jury convicted Andrew Howard Brannan of the murder of Kyle Dinkheller and sentenced him to death, and this Court unanimously affirmed on direct appeal. Brannan v. State, 275 Ga. 70, 561 S.E.2d 414 (2002). Brannan filed a petition for writ of habeas corpus on May 2, 2003, which he amended on August 4, 2005. An evidentiary hearing was held on August 21-23, 2006.
