COMOLLI v. STATE

No. 2D14-652.

152 So.3d 119 (2014)

Daryl COMOLLI, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Second District.

December 3, 2014.

Attorney(s) appearing for the Case

Howard L. Dimmig, II , Public Defender, and Tosha Cohen , Assistant Public Defender, Bartow, for Appellant.

Pamela Jo Bondi , Attorney General, Tallahassee, and Helene S. Parnes , Assistant Attorney General, Tampa, for Appellee.

Daryl Comolli appeals from the order revoking his probation. He argues that the evidence was insufficient to support the finding that his failure to keep his electronic monitoring device charged was a willful and substantial violation of a term of his probation. We agree and reverse.
