Christopher Brooks challenges the judgment and sentence imposed following a jury verdict finding him guilty of felony driving under the influence (DUI) under sections 316.193(1) and 316.193(2)(b)(1), Florida Statutes (2010). We affirm Mr. Brooks' judgment and sentence but write to discuss the trial court's denial of his request for a jury instruction on the defense of necessity.
