HALLMAN v. STATE

No. 3D12-2538.

114 So.3d 410 (2013)

Desmon HALLMAN, Appellant, v. The STATE of Florida, Appellee.

District Court of Appeal of Florida, Third District.

May 29, 2013.

Attorney(s) appearing for the Case

Desmon Hallman, in proper person.

Pamela Jo Bondi , Attorney General, and Douglas J. Glaid , Senior Assistant Attorney General, for appellee.

Before FERNANDEZ and LOGUE, JJ., and SCHWARTZ, Senior Judge.

PER CURIAM.

Desmon Hallman appeals the trial court's summary denial of his motion for post-conviction relief filed pursuant to rule 3.850(a), Florida Rules of Criminal Procedure. Because the trial court summarily denied the motion without attaching the portions of the record that refute Hallman's claims raised in his motion, we reverse and remand for an evidentiary hearing or other appropriate relief. See Fla. R.App. P. 9.141(b)(2)(A),(D).
