SICOLA v. STATE

No. 2D11-2734.

106 So.3d 54 (2013)

Francis Paul SICOLA, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Second District.

February 1, 2013.

Attorney(s) appearing for the Case

Howard L. Dimmig, II , Public Defender, and J.L. "Ray" LeGrande , Special Assistant Public Defender, Bartow, for Appellant.

Pamela Jo Bondi , Attorney General, Tallahassee, and John M. Klawikofsky , Assistant Attorney General, Tampa, for Appellee.

DAVIS, Judge.

Francis Paul Sicola challenges his conviction and sentence for first-degree murder. He was convicted following a jury trial, and the trial court sentenced him to life imprisonment. We affirm and write only to address Sicola's argument that the trial court committed fundamental reversible error by giving a certain jury instruction on manslaughter as a lesser included offense of first-degree murder.
