LEBEN v. STATE FARM FLORIDA INS. CO.

No. 4D10-3833.

93 So.3d 528 (2012)

Jack LEBEN and Joyce Leben, Appellants, v. STATE FARM FLORIDA INSURANCE COMPANY, Appellee.

District Court of Appeal of Florida, Fourth District.

August 1, 2012.

Attorney(s) appearing for the Case

Christopher J. Lynch of Hunter , Williams & Lynch, P.A., Coral Gables , and J. Warren Frazer of Ligman Martin, P.L., Miami, for appellants.

Kara Berard Rockenbach of Methe & Rockenbach, P.A., West Palm Beach, for appellee.

STEVENSON, J.

This appeal stems from a breach of contract action filed by Jack and Joyce Leben against State Farm Florida Insurance Company for its failure to cover roof damage following Hurricane Wilma in October of 2005. The trial court granted summary judgment in favor of State Farm, reasoning that the Lebens failed to comply with post-loss conditions under the policy, specifically by failing to give timely notice.
