The issue presented is whether the trial court erred in denying the admission of the partial deposition that was not completed due to the death of the deponent, and in denying the admission of the deponent's guilty plea in a related criminal case. We find that the trial court erred in excluding the partial deposition and the deponent's guilty plea. We, therefore, reverse the trial court's entry of a directed verdict and remand for a new trial.
