STATE v. BARBARY

No. 4D11-3345.

84 So.3d 1266 (2012)

STATE of Florida, Appellant, v. Curtis BARBARY, Appellee.

District Court of Appeal of Florida, Fourth District.

April 18, 2012.

Attorney(s) appearing for the Case

Pamela Jo Bondi , Attorney General, Tallahassee, and Melynda L. Melear , Assistant Attorney General, West Palm Beach, for appellant.

Carey Haughwout , Public Defender, and Narine N. Austin , Assistant Public Defender, West Palm Beach, for appellee.

PER CURIAM.

The state appeals the trial court's order granting the defendant's motion to suppress contraband seized from his home without a warrant. We affirm, holding that the warrantless entry into defendant's home was not justified either under the exigent circumstances doctrine or as a valid protective sweep. See Rozzo v. State, 75 So.3d 409 (Fla. 4th DCA 2011); Diaz v. State, 34 So.3d 797
