No. 5D11-3310.

87 So.3d 48 (2012)

ORANGE COUNTY SCHOOL BOARD, Appellant, v. Leona RACHMAN and Jonathan Schuman, Appellees.

District Court of Appeal of Florida, Fifth District.

Rehearing and Rehearing En Banc Denied May 9, 2012.

Attorney(s) appearing for the Case

John C. Palmerini , Associate General Counsel for Orange County School Board, Orlando, for Appellant.

Tobe M. Lev of Egan, Lev & Siwica, P.A., Orlando, for Appellees.

PER CURIAM.

The Orange County School Board (the "Board") timely appeals a final judgment on the pleadings in favor of teachers Leona Rachman and Jonathan Schuman, plaintiffs below, arguing that the trial court erred in its interpretation and application of section 121.091(9)(b)1.a., Florida Statutes (2010). That statute allows a school district to rehire a retired teacher in the year immediately following his or her retirement on an annual contract.
