We have for review a referee's report recommending that Michelle Erin Berthiaume be found guilty of professional misconduct and suspended from the practice of law for ten days. We have jurisdiction. See art. V, § 15, Fla. Const. We approve the referee's findings of fact. For the reasons discussed herein, we disapprove the referee's recommendation that Berthiaume be found not guilty of violating Rule Regulating the Florida Bar 4-8.4(c). We find...
