F.C. v. STATE

No. 3D10-301.

50 So.3d 796 (2011)

F.C., a juvenile, Appellant, v. The STATE of Florida, Appellee.

District Court of Appeal of Florida, Third District.

January 12, 2011.

Attorney(s) appearing for the Case

Carlos J. Martinez , Public Defender, and Marti Rothenberg , Assistant Public Defender, for appellant.

Pamela Jo Bondi , Attorney General, and Richard L. Polin , Assistant Attorney General, for appellee.

Before GERSTEN, SUAREZ, and ROTHENBERG, JJ.

ROTHENBERG, J.

The defendant appeals from a withhold of adjudication and order of probation. We affirm.

The defendant argues that the trial court erred in denying his motion for judgment of dismissal and convicting him of attempted robbery where the evidence showed he voluntarily abandoned his attempt to commit the robbery. We find the defendant's arguments to be unpersuasive. The defendant did not abandon the robbery.
