Crystal D. Charron ["Charron"] appeals the trial court's order granting summary final judgment in favor of Warren A. Birge ["Birge"] and its subsequent order denying rehearing. We reverse.

On February 20, 2008, William A. Smith ["Smith"]1 and Charron sued Birge, alleging negligence in relation to a motor vehicle accident that occurred on U.S. Highway 17-92, at or near Seminole Boulevard at Lake Monroe in Sanford, Florida...
