Mark Ladner and Diane DiGirolamo (the Ladners)1 appeal the final judgment entered in favor of AmSouth Bank2 on June 16, 2008, following a nonjury trial on their three-count amended counterclaim. We affirm in part, reverse in part, and remand for a new trial on portions of counts one and three of the Ladners' counterclaim.
