M.W. v. DEPARTMENT OF JUVENILE JUSTICE

No. 1D09-1799.

15 So.3d 782 (2009)

M.W., a child, Petitioner, v. DEPARTMENT OF JUVENILE JUSTICE, Respondent.

District Court of Appeal of Florida, First District.

Rehearing Denied August 25, 2009.

Attorney(s) appearing for the Case

Nancy Daniels, Public Defender, and Kara A. Fenlon, Assistant Public Defender, Tallahassee, for Petitioner.

Bill McCollum, Attorney General, and Anne Conley, Assistant Attorney General, Tallahassee, for Respondent.

KAHN, J.

M.W., a juvenile, petitions this court for habeas corpus relief, contending that he was unlawfully placed in secure detention based on a risk assessment instrument (RAI) that improperly "double scored" him for the same circumstance. Although M.W. has now been released from secure detention, we have retained jurisdiction in this matter because the issue is likely to recur yet may evade review. See J.R. v. State, 953 So.2d 690
