OPINION & ORDER

Plaintiff Tyron Dumel ("Plaintiff"), a pretrial detainee at Westchester County Jail at the time of the allegations, brings this Action under 42 U.S.C. § 1983 against Sergeant Matthew Kitt ("Kitt," "Sgt. Kitt," or "Defendant"). (See Am. Compl. at 1, 3 (Dkt. No. 33).)
