OPINION

Now before the Court is Defendant's motion to dismiss Plaintiff's federal trademark claims. In accordance with the Third Circuit Court of Appeals' remand in this matter, this Court now denies Defendant's motion to dismiss with respect to Plaintiff's claim under 15 U.S.C. § 1125(a).
