THIS CAUSE comes before the Court upon Defendant's Motion to Dismiss Plaintiffs Second Amended Complaint (D.E. 23), filed February 3, 2014. The Court is fully briefed on the issue.1 Upon review of the record and careful consideration, the Court finds that the Motion should be denied.
