I. SYNOPSIS

Pending before the Court are cross-motions for summary judgment, filed pursuant to Federal Rule of Civil Procedure 56. (See ECF Nos. 38, 41, 47, and 75). For the reasons stated below, the Court will GRANT Defendants' first motion for summary judgment (ECF No. 38) and will DENY Plaintiffs' motions for summary judgment (ECF Nos. 41 and 47)
