I. INTRODUCTION

On September 29, 2010, plaintiff Edward E. Ogalo ("plaintiff" or "Ogalo"), proceeding pro se and in forma pauperis, filed this action against the New York State Thruway Authority and its subsidiary, the New York State Canal Corporation ("Corporation") (collectively "defendants").
