MEMORANDUM OPINION

Before the court is the defendants' motion to dismiss Counts I and III of plaintiffs' complaint. For the reasons explained below, we grant the defendants' motion.

BACKGROUND

On December 1, 2012, a neighbor told plaintiff Al Phillips that a police officer was ticketing his car in front of his home. (Second Am. Compl. ¶ 8.)
