This matter is before the Court on Plaintiff Liberty Mutual Insurance Company's Motion to Dismiss Amended Counterclaim [D.E. 36]. The Court has reviewed Plaintiff's Motion and the record in this case and is otherwise fully advised in the premises. For the reasons set forth below, the Court denies Plaintiff's Motion.
