Defendants, Houghton Mifflin Harcourt Publishing Company ("HMH") and R.R. Donnelley & Sons Company ("Donnelly," and together with HMH, "Defendants") bring this motion seeking partial summary judgment on certain claims brought by Muench Photography, Inc. ("Muench" or "Plaintiff") [dkt. no. 96]. For the reasons set forth below, Defendants' motion is GRANTED in part and DENIED in part.
