Mario Fernando Santoro ("plaintiff'), a federal inmate, filed this suit pursuant to the Federal Tort Claims Act ("FTCA") [D.E.1, 9, 11]. The United States of America filed a motion to dismiss the FTCA claim pursuant to Rule 12(b)(1) and Rule 12(b)(6) [D.E.25, 26].
