OPINION AND ORDER

This matter is before the court on a motion for summary judgment filed by one of the defendants, Patrick Rzepka ("Officer Rzepka"), on December 10, 2012. The plaintiff, Robert Peacher ("Peacher"), filed a response to the motion on January 31, 2013, to which Officer Rzepka filed a reply on February 14, 2013. For the following reasons, the motion for summary judgment will be granted.
