Plaintiff Dale Ihnken was a concert promoter who organized a festival in Frederick County, Maryland, that was to be held Thursday to Sunday, June 18-21, 2009. Shortly after noon on Friday, June 19, however, after the festival had caused reported noise disturbances well into the previous night, county officials ordered the immediate closure and cancellation of the festival, evicting festivalgoers, vendors...
