MEMORANDUM OPINION AND ORDER

C. LYNWOOD SMITH JR., District Judge.

Plaintiff, John Wesley Burch, who is proceeding pro se, filed this case on September 7, 2010.1 His amended complaint asserts claims for alleged violations of rights guaranteed by the First, Fourth, and Fourteenth Amendments to the United States Constitution against the City of Florence, Alabama ("City"), Luke McIntyre, and Charles Philip Moss.
