Petitioner Joseph Fain was found guilty of trafficking in a controlled substance in the first degree and being a persistent felony offender in the first degree. He subsequently received an enhanced sentence of ten years' imprisonment. After exhausting his direct appeals, Fain filed an unsuccessful motion alleging ineffective assistance of his trial counsel under Rule 11.42 of the Kentucky Rules...
