I. SYNOPSIS

This matter comes before the Court on Plaintiffs Motion for Partial Summary Judgment (Doc. No. 56) and Defendant's Motion for Partial Summary Judgment (Doc. No. 62), both pursuant to Fed. R. Civ. P. 56. For reasons set forth herein, both Plaintiffs and Defendant's motions are hereby DENIED.
