MEMORANDUM OPINION

COLLEEN KOLLAR-KOTELLY, District Judge.

Plaintiff Julian C. White seeks documents regarding a criminal case purportedly prosecuted by the United States Attorney's Office for the Eastern District of New York in 1998. Plaintiff brought this suit against the United States Department of Justice ("DOJ") under the Freedom of Information Act ("FOIA"), 5 U.S.C. § 552. The parties filed cross motions for summary judgment.
