STARK, District Judge:

Pending before the Court is the Motion under Rule 17(a), Rule 12(b)(1), Rule 12(b)(6), and Rule 12(c) for Dismissal of New York's Claims on Behalf of Non-State Public Entities (Docket Item ("D.I.") 163 and, hereinafter, the "Donnelly Non-State Public Entities Motion") filed by defendant Intel Corporation ("Intel" or "Defendant").
