I. Introduction

The chain of events underlying this action originated in November, 2008 when Plaintiff Roger Preston's employment with Defendant Second Wind, Inc. ("Second Wind") was terminated. In March 2009, Plaintiff filed a complaint with the Massachusetts Commission Against Discrimination ("MCAD"), and in February 2011, Plaintiff brought this civil action.
