MEMORANDUM OPINION

AMY BERMAN JACKSON, District Judge.

Plaintiff Christopher Boultinghouse brings this pro se action against Harley G. Lappin in his official capacity as Director of the Federal Bureau of Prisons ("BOP"). Plaintiff alleges that the BOP's reliance on 28 C.F.R. § 550.58(a)(1)(vi)(B) (2000)1 to bar his eligibility for early release under 18 U.S.C. § 3621(e) (2006)2
