MEMORANDUM OPINION

These consolidated cases are before the Court on the parties' cross-motions for partial summary judgment.1 The Court heard oral argument on these motions at a hearing on September 16, 2011. For the reasons explained below, the Court will grant the plaintiffs' motion for partial summary judgment and deny the federal defendants' motion for partial summary judgment.
