MEMORANDUM OPINION AND ORDER

This matter comes before the Court on Defendant Waad Ramadan Alwan's motion to dismiss counts one and two of the criminal indictment (DN 40). The Government has responded (DN 42) and Defendant has replied (DN 44). This matter is now ripe for adjudication. For the reasons that follow, Defendant's motion is DENIED.
