Presently before the Court is a Motion for Summary Judgment by Defendants Vertis, Inc. and American Color Graphics (collectively "Defendants"). The instant motion arises out of a Complaint filed by Plaintiff Canadian National Railway Company ("Plaintiff") against Defendants for failing to pay tariff, circular and contract charges relating to the transportation of rolled paper via freight boxcars.
