OPINION

WILLIAM J. MARTINI, District Judge:

This matter comes before the Court on Defendant Hartz Mountain Corporation ("Hartz"), Sergeant's Pet Care Products ("Sergeant's"), and Summit Vetpharm, LLC's ("Summit") motions to dismiss pursuant to Federal Rules of Civil Procedure 12(b)(6) and 12(b)(2). There was no oral argument. Fed.R.Civ.P. 78. For the reasons stated below, Defendants' motions to dismiss is GRANTED in part and DENIED
