MEMORANDUM OPINION & ORDER

JANE J. BOYLE, District Judge.

Before the Court is Defendant L. Douglas Kiel's Motion to Dismiss Pursuant to Rule 12(b)(6) (doc. 33), filed January 1, 2011. For the reasons stated below, the Court finds that the Motion should be and hereby is GRANTED and that Plaintiff's claims should be and hereby are DISMISSED with prejudice.
