This matter came before the court for hearing on January 28, 2011, upon the motion to dismiss by defendants Deutsche Bank National Trust Company (Deutsche Bank) and Mortgage Electronic Registration Systems, Inc. (MERS). Defendants appeared through counsel; pro se plaintiff Erik Ostigaard did not appear. Based upon a review of the file, record, and proceedings herein, the court grants the motion.
