I. INTRODUCTION

Plaintiff Albert W. Malcolm ("plaintiff"), who proceeds pro and has been granted leave to proceed in forma pauperis, seeks judicial review of a decision of the Social Security Administration pursuant to 42 U.S.C. § 405(g). Presently before the court is a motion to dismiss filed by defendant Michael J. Astrue ("defendant"), Commissioner of Social Security Administration.
