Appellant Elisha S. Ortiz ("Ortiz") brings this appeal from the United Sates Bankruptcy Court for the District of Kansas, Case No. 09-21027-7, against appellee Eric C. Rajala, Trustee, ("Rajala"), in which the bankruptcy court ruled that Ortiz's annuity was not exempt under K.S.A. § 60-2312(b) and 11 U.S.C. § 522(d)(10)(E).
