Presently at issue are Plaintiff's Motion to Remand to State Court [#6] and Defendant's Motion to Dismiss the Third Cause of Action of Plaintiff's Complaint [#7]. Because this court lacks subject matter jurisdiction over Plaintiff's claims, Plaintiff's Motion to Remand to State Court [#6] is ALLOWED and Defendant's Motion to Dismiss the Third Cause of Action of Plaintiffs Complaint
